Welcome to TRACE Adventure.

These Terms of Service govern your use of the TRACE Adventure website and your purchase of products and services from us. By accessing our website or placing an order, you agree to these Terms of Service together with our Privacy Policy, Refund Policy and Shipping Policy.

TRACE Adventure is based in New Zealand and our online store is powered by Shopify.

1. Our Products

TRACE Adventure creates personalised maps using GPS data and other information supplied by our customers.

Because each TRACE is individually created, the appearance of your finished map will vary depending on your route, location, GPS data, photographs and other information supplied with your order.

We make every reasonable effort to accurately display our products online. Colours, imagery and the appearance of printed products may vary slightly from what you see on your screen due to differences in displays, printing and materials.

Product descriptions, formats, prices and availability may change from time to time.

2. Personalised Orders

When ordering a personalised TRACE map, you are responsible for providing the information and files requested during the ordering process.

Please check your order carefully before submitting it.

Because TRACE maps are personalised and individually created, changes or cancellations may not be possible once work on your map has begun.

If you realise you've made a mistake or need to change something after ordering, please contact us as soon as possible.

Returns and refunds are handled in accordance with our Refund Policy and your rights under applicable New Zealand consumer law.

3. Customer-Supplied GPS Data, Photos and Information

When placing an order, you may provide TRACE Adventure with GPS or GPX files, photographs, names, race information, official results and other content for use in creating your personalised map.

By providing this material, you confirm that you have the right to provide it to us and allow us to use it for the purpose of creating and fulfilling your order.

You are responsible for ensuring that the files and information you provide are accurate and complete.

TRACE Adventure is not responsible for inaccuracies in a finished map that result directly from incorrect, incomplete or inaccurate GPS data, names, photographs, race information or other information supplied by the customer.

GPS devices and activity platforms can record distance, elevation, location, time and other information differently. Statistics displayed on your TRACE are therefore based on the data available to us and may differ from official race results or statistics displayed by your GPS device or activity platform.

Where available, you may provide official race information when ordering.

4. Customer Photos

You confirm that you have the right to use any photographs you upload to TRACE Adventure and to allow us to reproduce those photographs as part of your personalised map.

Customer photographs are used for creating and fulfilling your order and are handled in accordance with our Privacy Policy.

The quality of photographs reproduced on your finished map will depend partly on the quality and resolution of the images supplied to us.

5. Social Media and Promotional Sharing

TRACE Adventure will not publicly share your personalised map or customer-supplied photographs for promotional or social-media purposes without your permission.

Where you choose the optional social-media sharing permission when ordering, you give TRACE Adventure permission to display and share your finished map and its incorporated photographs through TRACE Adventure's website, social-media channels and promotional material.

You may contact us if you later have concerns about content we have shared.

6. Prices and Payment

All prices displayed on the TRACE Adventure New Zealand store are in New Zealand dollars and include GST unless otherwise stated.

Shipping is additional for printed products and is shown during the ordering or checkout process.

Digital products do not incur physical shipping charges.

Payment must be successfully processed before an order can proceed.

We reserve the right to correct genuine pricing, product-description or other errors on our website. If an error affects an order you have already placed, we will contact you to discuss the available options.

7. Digital Products

Digital TRACE maps are supplied electronically in the format described on the relevant product page.

Digital maps are supplied for the customer's personal use. Purchasing a digital map does not transfer ownership of TRACE Adventure's underlying designs, templates, branding or other intellectual property.

Please refer to our Refund Policy for information about refunds relating to personalised digital products.

8. Printing and Physical Products

Printed TRACE maps are professionally produced using the materials described on the relevant product page.

Minor differences in colour or appearance can occur between digital previews, computer or phone displays and professionally printed products.

These normal production differences are not considered faults unless the product fails to meet applicable consumer guarantees.

9. Shipping and Delivery

Printed products are delivered according to our Shipping Policy.

Delivery timeframes are estimates and may be affected by printing schedules, courier delays, rural delivery or circumstances outside our reasonable control.

If your order arrives damaged, faulty or incorrect, please contact us as soon as possible with your order number and photographs showing the issue.

Nothing in these Terms limits any rights you may have under New Zealand consumer law in relation to delivery, damaged goods or faulty products.

10. Intellectual Property

Unless otherwise stated, the TRACE Adventure website, branding, logos, designs, map layouts, graphics, text and other original material created by TRACE Adventure remain the intellectual property of TRACE Adventure or the relevant rights holder.

Purchasing a TRACE product does not transfer ownership of TRACE Adventure's underlying templates, designs, branding, production methods or other intellectual property.

You may use your finished TRACE map for normal personal purposes, including displaying your printed map and sharing photographs of it.

You may not reproduce, modify, resell or commercially exploit TRACE Adventure designs or digital products without our prior permission.

Customer-supplied photographs and other customer-owned material remain the property of their respective owners.

11. Mapping and GPS Information

TRACE Adventure maps are created as personalised artwork and records of an adventure.

They are not intended for navigation, route planning, emergency use or safety-critical decision-making.

GPS tracks, satellite imagery, terrain information and other mapping data can contain errors or become outdated. Do not rely on a TRACE Adventure map as your sole source of navigation or safety information.

12. Third-Party Services and Links

Our website may use or link to third-party services, including Shopify, payment providers, shipping providers and tools that can assist customers with GPS or GPX files.

Third-party services operate under their own terms and privacy policies. TRACE Adventure is not responsible for the operation, availability or content of independent third-party websites or services.

13. Shopify

Our online store is powered by Shopify, which provides the ecommerce platform that enables us to sell our products and services online.

Purchases made through the TRACE Adventure store are transactions between you and TRACE Adventure.

Certain information may be processed by Shopify and other service providers as necessary to operate our store and fulfil orders. Please see our Privacy Policy for more information.

14. Privacy

Personal information and customer-supplied files are handled in accordance with our Privacy Policy.

15. Acceptable Use

You may use our website only for lawful purposes.

You must not misuse the website, attempt to interfere with its operation or security, introduce malicious software, access information without authorisation, or use our website or content in a way that infringes the rights of TRACE Adventure or another person.

16. Errors and Inaccuracies

Occasionally information on our website may contain typographical errors, inaccuracies or omissions relating to product descriptions, prices, promotions, shipping charges or availability.

We may correct errors or update information when necessary.

If a material error affects an order you have already placed, we will contact you where appropriate.

17. Consumer Guarantees

Nothing in these Terms of Service, our Refund Policy, Shipping Policy or any other TRACE Adventure policy is intended to exclude, restrict or modify any rights or remedies that cannot lawfully be excluded under the New Zealand Consumer Guarantees Act 1993, Fair Trading Act 1986 or other applicable New Zealand law.

Where those laws apply, your statutory rights remain unaffected.

18. Limitation of Liability

To the extent permitted by law, TRACE Adventure will not be responsible for indirect or consequential loss arising from the use of our website or products.

Nothing in this section limits or excludes liability where it would be unlawful to do so, including any rights or remedies available to consumers under applicable New Zealand law.

19. Changes to These Terms

We may update these Terms of Service from time to time to reflect changes to our products, services, website or legal requirements.

The current version will be available on our website.

20. Governing Law

These Terms of Service are governed by the laws of New Zealand.

Any disputes relating to these Terms will be dealt with in accordance with applicable New Zealand law.
